EU: Termination of definitive antidumping duty on imports of certain stainless steel fasteners and parts thereof from China and Chinese Taipei as well as on imports from the Philippines following the

 Anti-dumping

On August 13, 2008, the European Commission announced the initiation of a partial interim review of the anti-dumping duty imposed by Council Regulation (EC) No 1890/2005 on imports of certain stainless steel fasteners and parts thereof from China, Chinese Taipei, Indonesia, Thailand and Vietnam (Notice No 2008/C 206/08).
This partial review follows the application lodged by Header Plan Co., Ltd., an exporter from Vietnam.
The review is limited in scope to the examination of dumping as far as the applicant is concerned.
The products subject to investigation are classified under the following HS codes: 7318.1210, 7318.1410, 7318.1530, 7318.1551, 7318.1561 and 7318.1570. The original anti-dumping duty on imports from China, Chinese Taipei, Indonesia, Thailand and Vietnam was decided on November 14, 2005 by Council Regulation (EC) No 1890/2005 and entered into force on November 20, 2005.

On August 17, 2009, the European authorities terminated the partial interim review by amending Council Regulation (EC) No 1890/2005 (Council Regulation (EC) No 768/2009). It modified the rate of the duty imposed on goods exported by the Header Plan Co., Ltd., from 7.7% of the net free-at-Community-frontier price to 0%. The rate of the duty applicable to the other imports originating in Vietnam remains 7.7%. The rates of the duty imposed on imports originating from China, Chinese Taipei, Indonesia and Thailand remains unmodified since the review was limited in scope to the examination of dumping as far as the applicant was concerned. Those rates are the following: 27.4% on imports originating in China, at the exception of the companies Tengzhou Tengda Stainless Steel Product Co., Ltd, Tengzhou City and Tong Ming Enterprise (Jiaxing) Co. Ltd, Zhejiang whose exports are subject to a duty of 11.4% and 12.2% respectively; 24.6% on imports originating in Indonesia, at the exception of the company PT. Shye Chang Batam Indonesia, Batam, whose exports are subject to a duty of 9.8%; a rate ranging from 8.8% to 23.6% on imports originating in Chinese Taipei, depending on the producer (for details, see Table of Article 1.3 of Council Regulation (EC) No 1890/2005); 14.6% on imports originating in Thailand, at the exception of the companies Bunyat Industries 1998 Co. Ltd, Samutsakorn, Siam Screws (1994) Co. Ltd, Samutsakorn and A.B.P. Stainless Fasteners Co. Ltd, Ayutthaya whose exports are subject to a duty of 10.8%, 11.0% and 11.1% respectively. Council Regulation (EC) No 768/2009 was published in the Official Journal of the European Union (L 221) on August 25, 2009 and entered into force on August 26, 2009.

On November 19, 2010, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed on imports of certain stainless steel fasteners and parts thereof originating in China and Chinese Taipei (Notice No 2010/C 315/07). This sunset review follows a request lodged on August 19, 2010 by the European Industrial Fasteners Institute (EIFI) on behalf of producers representing more than 25% of the EU production of the subject goods. The request does not concern imports originating in Indonesia, Thailand and Vietnam. Hence, the duty imposed on imports originating in those three countries terminated on November 19, 2010 after five years of implementation. The products subject to the sunset review are still classified under the following HS codes: 7318.1210, 7318.1410, 7318.1530, 7318.1551, 7318.1561 and 7318.1570.

On January 4, 2012, the European authorities decided to extend the anti-dumping duty imposed on imports of certain stainless steel fasteners and parts thereof from China and Chinese Taipei (Council Implementing Regulation (EU) No 2/2012). The rate of the duty imposed on imports originating in China is 27.4% of the net free-at-Union-frontier price, at the exception of the companies Tengzhou Tengda Stainless Steel Product Co. Ltd., Tengzhou City and Tong Ming Enterprise (Jiaxing) Co. Ltd., Zhejiang whose exports are subject to a duty of 11.4% and 12.2% respectively. The rate of the duty imposed on imports originating in Chinese Taipei ranges from 8.8% to 23.6%, depending on the exporting company producer (for details, see Table of Article 1.2 of Council Implementing Regulation (EU) No 2/2012). Council Implementing Regulation (EU) No 2/2012 was published in the Official Journal of the European Union (L 5) on January 1, 2012 and entered into force on January 8, 2012.

On June 6, 2013, the European Commission announced the initiation of a partial interim review of the anti-dumping duty imposed by Council Implementing Regulation (EU) No 2/2012 on imports of certain stainless steel fasteners and parts thereof from China and Chinese Taipei (Notice No 2013/C 160/03). This partial review follows the application lodged by Sheh Kai Precision Co., Ltd., an exporting producer from Chinese Taipei. The review covers imports originating both in China and Chinese Taipei. The products subject to the partial interim review are still classified under the following HS codes: 7318.1210, 7318.1410, 7318.1530, 7318.1551, 7318.1561 and 7318.1570.

On July 30, 2014, the European authorities terminated the partial interim review by amending Council Regulation (EC) No 1890/2005, Council Implementing Regulation (EU) No 2/2012 and Council Implementing Regulation (EU) No 205/2013 (Commission Implementing Regulation (EU) No 830/2014). The product scope has been redefined by excluding bi-metal fasteners and bi-metal self-tapping screws (both classified under HS code ex 7318.1410) from the goods subject to the duty. However, excepting those two goods, HS code 7318.14140 remains concerned. Commission Implementing Regulation (EU) No 830/2014 was published in the Official Journal of the European Union (L 228) on July 31, 2014 and entered into force on August 1, 2014 with retroactive application back from November 20, 2005.

On 8 January 2017, the definitive duty imposed on imports of the subject good from China and Chinese Taipei was terminated. As this duty was terminated the duty imposed on imports of the same good from the Philippines was subsequently also terminated, see related intervention.
